The CALM (Cannabis Arbitration & Legal Mediation) sponsored by the NORML Women’s Alliance is a program for alternative resolution of disputes among businesses within the cannabis industry. NORML Women’s Alliance is the fiscal sponsor for CALM.
This program will initially address disputes in Northern and Southern California, with the expectation of expanding across the country as it scales up to meet the anticipated demand of the cannabis industry. Its mediators and arbitrators are recognized experts in their fields and are knowledgeable concerning the cannabis industry. Thus they will provide mediation and arbitration services unmatched by current Alternative Dispute Resolution providers often staffed by retired judges, many of whom are former prosecutors.
The CALM web portal to access this service is through NORML Women’s Alliance (www.normlwomensalliance.org). Upon submission of a dispute for mediation to avoid litigation or arbitration, a mediator or arbitrator will be appointed to assist in resolving that dispute. AAA mediation and commercial arbitration rules will be followed, unless modified by the parties.
Counsel are urged to include contract clauses which call for mediation as a prerequisite to litigation, and which limit attorneys’ fees awards if mediation is not attempted.
Fees will be invoiced for these services through the CALM program. The cost of mediation will include all hearing and preparation time. Arbitrations will be billed on a daily rate as well.
